2. Acceptance

By creating an account or otherwise using Bannerly, you agree to these Terms and to the Privacy Policy. Links to both are shown before you complete a paid purchase.

3. The service

Bannerly is a SaaS platform that lets you create and customize digital banner and social-profile visual assets (LinkedIn, Twitter/X, and Facebook profile banners, among other formats) using templates, your own content, and customization tools, including optional connections to external services (e.g. Stripe, Meta/Instagram, LinkedIn) to populate banners with live data.

You retain ownership of the content you upload (text, images, logos, and other assets). By uploading content, you grant Bannerly only the rights necessary to store, process, and render it, and to generate the visual asset you requested. You must have the necessary rights to any logos, photos, trademarks, or other third-party content you upload.

Unless prohibited by third-party rights or applicable law, you may download and use banners generated through Bannerly for personal or commercial purposes. Bannerly does not grant you any rights to third-party trademarks, copyrighted images, or other material you supplied yourself.

Bannerly may integrate with external services such as Stripe, Meta/Instagram, and LinkedIn. Those services remain governed by their own terms. Bannerly cannot guarantee the continued availability of any third-party API, permission, or feature; a third-party provider changing or withdrawing its API or access is not a breach of these Terms by Bannerly.

Prices are shown in euros and may be subject to applicable taxes displayed at checkout. The price and plan details shown on the checkout page at the time of purchase govern that purchase.

10. Payments

Payments are processed by Stripe via Stripe Checkout. Bannerly does not receive or store your full card details — these are entered directly with Stripe. See Stripe's own terms and privacy policy for how it handles your payment information.

11. Subscription renewal

The Pro Monthly plan automatically renews each month at the price shown at checkout until you cancel. The Pro Lifetime plan is a one-time payment and does not renew.

12. Cancellation

You can request cancellation of an active Pro Monthly subscription at any time by emailing support@bannerly.me from your account's email address, or from your Account page once self-service cancellation is available there. Cancellation stops future renewals; you keep access to Pro features until the end of the period you already paid for.

13. Refunds and withdrawal rights

Consumers in the EU/France purchasing remotely generally benefit from a statutory 14-day withdrawal ("cooling-off") right, subject to legal exceptions. Because Pro access is activated immediately at checkout, French/EU consumer law allows this right to be waived only where you have given an explicit request for immediate access and, for digital content, acknowledged the loss of the withdrawal right once the service has begun — this acknowledgment must be captured at checkout before purchase. We do not treat payment alone as an automatic waiver of your withdrawal rights.

15. Suspension and termination

We may suspend or terminate your account for security risk, fraud, unlawful conduct, or a material violation of these Terms. You may terminate or delete your account at any time — see the Privacy Policy's account deletion section.

16. Intellectual property

Bannerly's software, branding, interface, and templates we own, and other original material, remain protected. We do not claim ownership over third-party assets or your own content; see the Legal Notice.

17. Availability

We aim to provide a reliable service, but we cannot guarantee continuous or error-free availability. This does not remove any statutory obligation we cannot lawfully exclude.

18. Liability

To the extent permitted by law, Bannerly's liability for damages arising from use of the service is limited to direct damages, and excludes indirect or consequential loss. This limitation does not exclude liability that cannot legally be excluded, or any mandatory right you have as a consumer. For business customers, our aggregate liability under these Terms is limited to the amount you paid us in the 12 months preceding the claim.

We may evolve, add, or remove features over time. Where a change materially and adversely affects paid users, we will provide reasonable notice.

20. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated appropriately (e.g. by email or an in-app notice) and reflected in the "Last updated" date above.

21. Governing law

These Terms are governed by French law. For consumers residing in the European Union, this choice of law does not deprive you of mandatory protections granted by the law of your country of residence.
